Notice to Convene an Extraordinary General Meeting (EGM)

I would like you to remember that the Club (Cheam Squash Club Section) needs you to attend the EGM set for this Monday 29th June at 7:30pm in the Connolly Room.

I would appreciate members to attend this meeting and read the reasons for this vote in the notes below


Dear Sir

FORMAL DEMAND – UNPAID SECTION RENT & OTHER FINANCIAL
COMMITMENTS DUE TO CHEAM SPORTS CLUB

I write in my capacity as Club Secretary, on the instructions of the Executive Officers of Cheam Sports Club (“the Club”) pursuant to Paragraph 14.1 of the Club’s Rules &
Regulations.

1. Rent Due 2025
Pursuant to {paragraph 13.1 of the Rules & Regulations, the Executive Officers difemerine an annual rent payable by each Section. We note that the Chair of the Cricket Section presented a summary of rent for 2025 to the Executive Committee.
This included a wholly unauthorised and illegitimate “credit” claimed by Dr Safeer Butt (chair of our cricket section) of £8,500.00. in relation to junior footballers using the Sports Club’s field to train for a total of circa 40 hours across the summer, i.e. a rate of about £250/hour. Our Sports Club’s field is a shared resource for all members and the children were authorised by our Sports Club to make use of our field, as will
be tennis for the upcoming summer sports camp for all.

As at the date of the is letter the following sums remain outstanding from our cricket section:
Annual unpaid Rent for 2025 £8,500.00
Annual Rent for 2025 TBA (the rental figure claimed by the cricket section does not match the Sports Club’s Records)
The above sum fell due of 5th April 2026 latest and remains unpaid.

2. Rule 14.1 Rent Arrears
The Rules & Regulations of our Sports Club provides:
“Any Section that fails to pay its rent or meet any other financial commitment to the Club by the dure due date shall be called upon to explain its action to the Executive Committee which shall have the power to take such remedial actions as it thinks fits, Our cricket section is accordingly, called upon, by this letter, to explain its failure to
discharge the sums identified in Section 1 above,

3. Required Action
The Executive Officers require our cricket section to take the following steps:

A. Pay the sum of £8,500.00 to the Sports Club within twenty-one days of the date of this letter by bank transfer,

B. Attend a meeting of the Executive Committee, date to be advised, at which our cricket section will be invited to explain the non-payment and to make representations as to any payment plan it wishes to propose, including rental of the Sports Club’s provision of cricket facilities for 2026.

Our cricket section shall be entitled to be represented by its Secretary and up to two further nominated and elected cricket section officers.

4. Consequences of non-compliance
Should our cricket section fail to make payment in full, or fail to attend the meeting referred to above without good cause, the Executive Committee will honour their obligation to consider such remedial action as it thinks fit under Rule 14,1, which may include (without limitation):
Suspension of our cricket section’s use of our Sports Club’s grounds, facilities and buildings

Withdrawal of our Sports Club’s support for fixtures, bookings, sub-lets and bar facilities for our cricket section events.

Termination of the membership of individual section members under Rule 12.2 in respect of unpaid annual subscriptions.
Such further or other action as the Executive Committee considers appropriate under Rule 14.1 and the recovery of the outstanding sums as a civil debt.

5. Reservation of Rights
Nothing in this letter shall be taken as a waiver of any of our Sports Club’s rights and remedies under our Rules and Regulations or at law, all of which are expressively reserved. This letter is sent without prejudice to any disciplinary action which the Executive Committee may separately consider under 27 and 28 of the Rules and Regulations in relation to the conduct of any individual member.

6. Acknowledgement
We request acknowledgement of this letter in writing within seven (7) days by our cricket section’s committee.
